What happens in divorce proceedings?

Divorce proceedings involve submitting paperwork to the court and applying for a final divorce order. 

Along the way, our divorce solicitors will also represent you in negotiations with your ex-spouse, either at meetings or at mediation. We discuss with you the approach you would like us to take and advise you on the limits of what is achievable within the law.

  • Do I have to go to court to get a divorce?

    No, not necessarily. Not all divorces need to be fought out in court. We can explore mediation and arbitration to reach a settlement and we will represent you and your interests in these negotiations.

  • What happens if my ex-spouse ignores the court order, or doesn’t comply with it?

    We can intervene to speak to your ex-spouse, so that you don’t have to. If necessary, we can ask the court to enforce compliance with the order. Your ex-spouse can face fines, or they might have their assets seized if they don’t comply with the order.

  • How do I get a fair financial settlement in my divorce?

    First, we look at your own financial situation. What assets, savings, investments, pensions, and debts do you have? Then we enter negotiations with your ex-spouse.

    We work closely with you to agree on a strategy for those negotiations. We can be firm but conciliatory, or take a hard line on your non-negotiables.

    If negotiations end in deadlock, we can apply to court to find a settlement deemed fair by a judge.

  • What happens if my ex isn’t honest about their financial situation?

    Where we think your ex-spouse may be concealing assets, we can apply for disclosure orders from the court. Or if it appears that valuations have been downplayed, we can instruct experts to give an accurate assessment.

  • How do you work out child arrangements when I get divorced?
