What are your rights in a divorce with an international element?

It may be the case that you, or your ex-spouse, want to live abroad after your divorce or separation.  

In these circumstances, you will need to agree on the movement of your children between countries. In other words, one parent can’t take the children abroad, without the other’s permission. 

Our International divorce lawyers can help you negotiate an agreement with your ex-spouse, but if an agreement is not possible, we can apply to the court for a relocation order. If the order is granted, you will be able take your children abroad, even if the other parent objects.

  • What can I do if I think my partner is not being honest about the assets that they hold abroad?

    If you think your ex-spouse may be concealing assets that are overseas, we can carry out a tracing exercise to locate them.

    Similarly, if you suspect that your ex-spouse may covertly move assets abroad to keep them out of sight, we can apply to court to freeze certain assets.

  • Can I choose which country to file my divorce in?

    Yes. You might have the option to divorce in more than one country. We work with international divorce lawyers across the world to analyse which country is best placed to oversee your divorce.

    In some cases, you may need to apply to the English Court for a financial “top up”, if you think that the financial provision made for you abroad was inadequate.

  • Can I take my children away from the UK to live closer to my parents in another country?

    If your children are under 18 then you’ll need the consent of everyone with parental responsibility (usually the other parent) to take your children to live abroad permanently. If the other person doesn’t give consent, then you can apply to court for a specific issue order.
