What legal options do you have as the victim of domestic abuse?

The court can grant certain orders which prevent an abusive person from contacting you or coming within a certain distance of you and your home or workplace.

  • Non-molestation orderThis prevents a person from contacting you or going near you or your home. 
  • Occupation orderAn occupation order can remove someone from your home or prevent them from returning. 

If you need an emergency intervention, our specialist lawyers can apply for a non-molestation and/or occupation order urgently, and this is often issued within 48 hours if immediate protection is necessary.

These are forms of emergency injunctions which restricts the abuser’s access to you or your home. If the abuser fails to comply with the orders, they could face jail time.

  • I need help urgently. What can you do?

    If you’re in immediate danger, call 999 to speak to the police. If you need an emergency intervention, we can apply for a protection order urgently, and this is often issued within 48 hours. This is a form of emergency injunction which restricts the abuser’s access to you. If they fail to comply with the order, they could face jail time.

  • What amounts to abuse?

    Many victims of domestic abuse do not recognise that the behaviour they are facing is unacceptable.

    Domestic abuse can look like any of the following:

    Physical or sexual abuse: Any type of assault including pushing, slapping, punching or any unwanted sexual contact amounts to domestic abuse.

    Stalking or harassment: This can take many forms such as being followed or tracked, or being bombarded with phone calls or messages.

    Online or social media abuse: Posting private photographs of you or abusive messages about you on social media platforms.

    Psychological or mental abuse: Includes gaslighting and being spoken to in an abusive or derogatory manner.

    Coercion and control or financial abuse: Preventing you from seeing family and friends or restricting your access to money. Your partner may be monitoring your phone or preventing you from working.

  • Do I have to go to court?

    Not necessarily. If you want a legally binding order against a domestic abuser, then you will have to go to court. But we understand that many clients fear the repercussions of going to court. If you think that court is not quite the right option yet, we will signpost you to other sources of help and support.

  • What is a non-molestation order?

    This prevents a person from contacting you or going near you or your home.

  • What is an occupation order?

  • What is a restraining order?

    A restraining order is available in conjunction with criminal proceedings. It stops the person contacting you, or visiting your address or workplace.
